Article 37, paragraph 3 of the new Code of Civil Procedure gives the Court of Québec that hears youth matters the possibility to rule on custody when asked to do so. This provision favours new structuring and linking of the jurisdictions of the Court of Québec and the Superior Court. The purpose of the project is to evaluate the conditions for defining a joint procedure that would open the way to greater collaboration on family matters, which used to be limited by strict constitutional subdivision of the jurisdictions of each court.
